Release of liability waiver.

OCON DEFENSE LLC – RELEASE OF LIABILITY, WAIVER, AND ASSUMPTION OF RISK AGREEMENT

This Release of Liability and Waiver Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in consideration for being permitted to attend and/or participate in firearms-related training, including but not limited to concealed carry weapons (CCW) instruction, provided by OCON Defense LLC (“the Company”)

1. Acknowledgment of Risk

Participant understands and acknowledges that:

• Firearms training involves inherent and significant risks, including but not limited to accidental discharge, injury, death, permanent disability, hearing loss, property damage, and exposure to lead or other hazardous materials.

• The use of firearms, ammunition, and training equipment may result in malfunctions, failures, or defects beyond the Company’s control.

• Participation in firearms training is strictly voluntary, and Participant assumes all risks, both known and unknown, associated with attendance and participation.

2. Safety Rules and Participant Responsibilities

Participant understands and agrees that:

• They will follow all safety rules, policies, commands, and instructions provided by instructors, range staff, and the Company at all times.

• Failure to comply with safety rules may result in immediate removal from training without refund.

• Any firearms, accessories, or ammunition brought by Participant must be legal, properly maintained, and safe to operate.

• Participant must use appropriate personal protective equipment, including eye and ear protection, and agrees to stop training if equipment becomes unsafe.

• Participant is solely responsible for the condition, legality, and function of any equipment or firearms they supply.

3. Education-Only Disclaimer (No Legal Advice; No Guarantee)

Participant understands and agrees that:

• Training provided by the Company is for educational purposes only and does not constitute legal advice.

• The Company does not guarantee, promise, or represent that completing any course will result in:

• Issuance or approval of a CCW permit,

• Any legal outcome in Participant’s favor,

• Authorization to carry a firearm, or

• Compliance with federal, state, or local laws.

• Participant is solely responsible for understanding and complying with applicable laws.

4. Release of Liability

Participant agrees to release, discharge, indemnify, and hold harmless OCON Defense LLC, its owners, officers, employees, instructors, contractors, volunteers, and affiliates from any and all claims, demands, causes of action, damages, or liabilities of any kind, arising out of or connected with:

• Injuries, death, property damage, or other harm resulting from Participant’s involvement in firearms training.

• Future incidents involving the use or misuse of firearms—including lawful or unlawful shootings—committed by Participant.

• Malfunctions, defects, or failures of firearms, ammunition, or accessories used before, during, or after training.

• Participant’s application for, or failure to obtain, any permit, certification, or license.

• The actions, negligence, or conduct of other participants.

• Exposure to environmental hazards including lead and noise.

This release does not apply to the Company’s gross negligence or willful misconduct.

5. Responsibility for Conduct

Participant understands and agrees that:

• The Company is not responsible for Participant’s actions outside the scope of training.

• Any negligent, reckless, criminal, or unlawful act committed by Participant is solely their own responsibility.

• The Company makes no warranty regarding Participant’s judgment, ability, or decision-making after training.

6. Medical Treatment, Fitness, and Insurance

Participant acknowledges and agrees that:

• Firearms training is physically and mentally demanding; Participant certifies they are physically and mentally fit to participate.

• Participant is encouraged and expected to carry their own medical and health insurance.

• The Company does not provide health, accident, or liability insurance for participants.

• If injury or medical emergency occurs, Participant authorizes the Company to seek emergency medical treatment on their behalf.

• Participant assumes all financial responsibility for any medical expenses resulting from injury or incident.

7. Media Release

Participant grants OCON Defense LLC permission to photograph, film, or otherwise record participation in training. Such media may be used for promotional, educational, training, or other lawful purposes without compensation.

Participant:

• Waives any right to inspect or approve finished media,

• Releases the Company from any liability related to the creation or use of such media.

If Participant does not wish to be recorded, they must notify the Company in writing prior to participation.

8. Binding Effect

This Agreement is binding upon Participant and their heirs, executors, administrators, legal representatives, and assigns.

If any part of this Agreement is found unenforceable, the remaining provisions shall continue in full force and effect.

9. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of California.
